Memry Application

Personal Data Processing Policy of CherryPeak s.r.o.

(hereinafter referred to as “CherryPeak” or “we”)

CherryPeak, as the controller of the information system in which personal data are processed, issues this policy for data subjects in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

The Memry application (hereinafter referred to as the “application”) is an information society service operated by CherryPeak, enabling users to create interactive postcards, primarily for personal and gift purposes. Postcards may be personalized using augmented reality (AR) or video content, which is made accessible via a QR code on a physical or digital medium.

By using the application and submitting an order, the user declares that they have familiarized themselves with this policy and agree to the processing of their personal data in accordance with it.

What personal data we process

The processing of personal data is carried out in accordance with:

  • the GDPR
  • Act No. 18/2018 Coll. on the Protection of Personal Data

We process only the personal data necessary for the proper provision of services. Data are processed by automated and non-automated means in secure information systems.

Purposes of processing and legal bases

Creation and processing of orders

  • consent of the data subject (Art. 6(1)(a) GDPR)
  • performance of a contract (Art. 6(1)(b) GDPR)

Provision of application services

  • consent of the data subject
  • performance of a contract

Marketing

  • consent of the data subject
  • legitimate interest (Art. 6(1)(f) GDPR)

Protection of legal claims

  • legitimate interest

Accounting and tax purposes

  • compliance with a legal obligation

Statistical and analytical purposes

  • Article 89 GDPR

Recipients of personal data

Personal data may be disclosed to:

  • hosting and technical service providers,
  • payment service providers,
  • partners providing postcard printing and delivery,
  • persons who scan the QR code – exclusively for content published by the user.

Transfer of data outside the EU

Personal data are not transferred outside the European Economic Area.

Data retention period

Personal data are stored only for the period necessary to fulfill the purposes of processing or for the period required by applicable law.

Uninstalling the application does not result in the automatic deletion of personal data.

Protection of personal data

We apply appropriate technical, organizational, and security measures to protect personal data. Access to personal data is granted only to authorized persons.

Automated decision-making

Personal data are not used for automated individual decision-making or profiling within the meaning of Article 22 GDPR.

Rights of the data subject

You have the right to:

  • access your personal data,
  • rectification or erasure,
  • restriction of processing,
  • data portability,
  • withdraw consent at any time,
  • object to processing.
